On re-hearing the High Court concluded the CCTV and photographs showed actual contact or at least tight contact and that the appellant had failed to keep a safe and appropriate distance, conduct objectively below the standard in s38(2) RTO; therefore the prosecution proved careless driving beyond reasonable doubt and the appeal is dismissed.
