The court vacated the registered Amended Writ because (1) its registration had in any event ceased to have effect under LRO s.17, (2) the 2019 Action had not been prosecuted bona fide since June 2019 such that bad faith could be inferred under LRO s.19 and authority, and (3) the Amended Writ did not plead any proprietary interest in the Properties and therefore was not registrable as a lis pendens; consequentially an undertaking not to re-register was accepted and indemnity costs were awarded to the applicant.
