The Tribunal held that the Block Government Lease covenant operated as a user restriction and that s12(c) of the LRO applied so development potential for NTEH could not be taken into account; both northern and southern sites lacked proven vehicular access at the resumption date; therefore the best use was open storage with pedestrian access only and compensation was assessed on that basis using selected open-storage comparables, resulting in the awards set out in the judgment.
