The District Court lacks jurisdiction because the plaintiff's claim for damages is a liquidated or unliquidated claim arising from breach/repudiation of an employment contract, and such claims fall within the exclusive jurisdiction of the Labour Tribunal under s.7 of the Labour Tribunal Ordinance; accordingly the matter must be commenced in the Labour Tribunal unless the Tribunal declines jurisdiction under s.10.
