Section 12(c) of the Lands Resumption Ordinance excludes compensation for development potential or hope value embedded in comparables; where the Government shows comparables contain such hope value the burden shifts to the claimant to demonstrate appropriate adjustments; a tribunal award based on unadjusted comparables embedding development potential is unsustainable and must be set aside and remitted for reassessment.
