The Incorporated Owners of Honour Building v. LOU CHUI SIM
- Citation
- The Incorporated Owners of Honour Building v. LOU CHUI SIM
- Court
- Lands Tribunal
- Case number
- LDBM373/1999
Master's dismissal was incorrect because court records showed objections were lodged before final certificate or, at minimum, the Master failed to exercise the statutory discretion under Order 62 r16 to permit an out-of-time application; furthermore, statutory and procedural law (s12(2) Lands Tribunal Ordinance and Order 62) requires taxation of Lands Tribunal costs to be dealt with in the Court of First Instance by High Court taxing officers; accordingly the Master's decision is set aside and taxation transferred to the High Court.
