The Court of Appeal held that liability to contribute to costs is a matter of internal arrangements among owners governed by the Deed of Mutual Covenant; because individual owners were not parties, the court could not make an order apportioning liability between them or interpret the DMC to bind them; accordingly the appeal was dismissed and no apportionment order was made.
