Appellant, as the driver cutting across from the inner lane, failed to exercise the requisite vigilance when changing lanes despite observing the other vehicle; a reasonably cautious driver would have slowed or remained in the inner lane, and the prosecution proved careless driving beyond reasonable doubt, therefore the conviction is upheld.
