The appeal is dismissed because the Applicant failed to raise any viable ground to reverse the Deputy High Court Judge's refusal of leave; no error of law, procedural unfairness or irrationality in the Board's decision was demonstrated; new points not raised below cannot be advanced for the first time on appeal.

The application for extension of time to appeal was dismissed because the Judge's decision was sent to the applicant's last known address and not returned, the applicant provided no reasonable explanation for the delay or failure to update her address, and the intended appeal was without merit as no arguable error of law, procedural unfairness or Wednesbury unreasonableness was identified; accordingly there was no basis to extend time or disturb the refusal of leave for judicial review.

The Adjudicator's findings were supported by the evidence, the appeal bundle was served within the prescribed period, qualified interpretation and assistance were available, the applicant failed to show prejudice from lack of counsel or late service, and the Board's decision was neither procedurally unfair nor Wednesbury unreasonable; consequently there are no reasonably arguable grounds and leave is refused.

Extension of time was refused because the applicant's delay (nearly six months) was serious and unexplained (court papers returned), and the intended appeal was without prospect of success because no arguable error was identified in the Judge's or Board's decisions; accordingly it was futile to extend time and the summons was dismissed.
