The appeal is dismissed: the trial judge's directions on provocation, good character and the 'last straw' were adequate in the context of the evidence; failure to adopt the Paria formulation was not a material error and the jury were not misled given the evidence and counsel's submissions.

Although the trial judge omitted a formal 'last straw' direction and a specific 'revenge' direction, the summing up comprehensively presented the applicant's account and the history of provocative conduct so the omissions were immaterial; there was strong evidence of murder and the conviction was neither unsafe nor unsatisfactory, therefore leave is granted but the appeal is dismissed.

The Presiding Officer failed to apply the correct legal approach; given the facts he accepted, the incidents cumulatively amounted to deliberate flouting of essential contractual duties and thus repudiatory conduct justifying summary dismissal under section 9 of the Employment Ordinance; waiver was not established by the period of delay; the awards for wages in lieu of notice and long service payment were set aside.
