The combined heroin content (17.39g) required a starting point of six years under the Lau Tak-ming tariff; after allowing the appropriate reduction for a guilty plea the proper effective sentence was four years, and the sentences were ordered to run wholly concurrently to reflect totality, so the appeal was allowed to reduce the effective term to four years.

The application for leave to appeal was dismissed because the trial judge provided detailed, reasoned findings applying the Lau Tak-ming guidelines, concluding that despite D2's youth the offender's assertive role and streetwise conduct made a training centre inappropriate and the custodial sentence imposed was not excessive.
