Because counsel had been recently instructed and had not seen the Notice of Appeal due to apparent negligence by the instructing solicitors, the court must grant an adjournment to avoid penalising the appellant; the solicitors must be required to show cause at the adjourned hearing why they should not personally pay the costs caused by the adjournment and notice of that hearing should be given to the Law Society.
