The applicants' claim was a public law legitimate expectation that failed because the 1987 Policy Statement did not apply: the land was not used for the special purpose and there were assignments in breach; most original lessees were no longer parties so a fresh lease to the remaining applicant would not renew the old lease; consequently there was no private property or civil right of HK$1,000,000 or more within s.22(1)(a) nor any general public importance under s.22(1)(b); the application for leave to appeal is dismissed with costs.
