Leave out of time is refused because the sentencing transcripts show the judge considered and rejected the applicant's claim of believing the drug was ecstasy, the applicant failed to demonstrate a genuine mistaken belief on the evidence, and even if such a belief were proved it would only permit a discount from the tariff for the actual drug rather than reclassification of the offence.
