The Court held that given the seriousness of the injuries, the near certainty of death had the victim fallen from the 20th floor, and the absence of sufficient mitigating factors to outweigh those aggravating features, the sentence of 13 years imprisonment was not manifestly excessive and the judge did not err in principle.

The trial judge's acceptance of the prosecution witnesses and rejection of the appellant and his witness was reasonable on the evidence; the cautioned statement was properly admitted; the missing rent receipt did not prejudice the defence; and the sentences were within the applicable guidelines — hence the convictions stand and leave to appeal sentence is refused.

The guilty plea was not a nullity because adoption of counsel's advice does not negate a voluntary and deliberate plea; the sentence imposed (ten months consecutive) was within proper judicial discretion and there was no basis to grant leave to appeal; both applications were refused.
