On the evidence the Plaintiff established a common intention constructive trust: she provided the purchase price, paid renovations, utilities and mortgage contributions and the parties' conduct and documents supported an express/common intention that the legal title be held for her; the TPS Right Defence and Inaction Defence were rejected as unproved or unsupported; accordingly the court declared that Yip Choi Koon held the Property on trust for the Plaintiff and that his estate holds it on trust after his death.
