    The judge lawfully exercised his discretion under Order 62 to deprive the successful 2nd Defendant of her costs because her defence rested on concocted theories and numerous irrelevant issues that objectively caused unnecessary and substantial additional litigation and expense; accordingly the costs order nisi of no order as to costs was affirmed and the 2nd Defendant's own costs are to be taxed under Legal Aid Regulations.
