The Wife failed to establish a basis for indemnity costs because it cannot be shown that the Firm would have been financially worse off had it accepted the Wife's mutual abandonment offer, and in any event the offer may not have been a valid sanctioned offer under Order 22; therefore the application to vary the costs order was dismissed.
