The court found MCAL's failure to comply with clear case management directions and deadlines, their delay in preparing and serving trial bundles, their inadequate follow-up with the Legal Aid Department and their piecemeal disclosure of correspondence constituted inexcusable misconduct and a serious dereliction of duty causally leading to the adjournment of the PTR; accordingly a wasted costs order was appropriate and MCAL were personally liable to pay the defendant assessed wasted costs of HK$60,233.
