- Court
- Court of Appeal
- Case number
- CACV157/1982
By majority the Court held that the express wording 'is valid until the 31st day of March, 1982' unambiguously terminated all obligations under the March 2, 1982 bond on that date; therefore a demand and payment made after that date could not be sustained under the bond, and the letters of indemnity/authority did not lawfully validate or give the bank carte blanche to make payments after the bond had ceased because those instruments were causally tied to the bond and did not override the clear temporal limitation.
