The Court held that it may, in its discretion, take into account actual post-sentence cooperation (such as giving evidence that leads to conviction) but should not give credit for mere promises to cooperate; Clause XV does not prevent the Court of Appeal from reducing a sentence, and on the facts the total sentence of nine years was not manifestly excessive, so the application to reduce was dismissed.
