Defendant's renovation works generated excessive noise and vibration amounting to an actionable nuisance and materially accelerated/caused the damage to plaintiff's flat; owner liable despite contractor; plaintiff entitled to damages totalling HKD 102,000 and costs.

The Appeal Committee held that the certified questions as framed were inadequate to resolve the appeal because whether a defendant is guilty depends on the proved facts and contractual arrangements rather than ipso facto application of statutory definitions; accordingly the appropriate course was to allow the matter to proceed to the Court of Final Appeal under s.32(2) so all issues including whether the offences are strict liability and the factual question of maintenance and knowledge may be fully examined.

The Court concluded that the legal questions raised were of great and general importance and certified two specific points of law concerning the interpretation of ss.2 and 8(1)(a) of the Telecommunication Ordinance and the scope of strict liability for determination by the Court of Final Appeal; costs were reserved to that court.

The 1st Defendant undertook to provide an organised tour which included the speedboat crossing as an integral component; it therefore owed a primary contractual and non-delegable duty to ensure the safety of participants and breached that duty by failing to ensure a safe system of operation for the speedboat, rendering it liable for the fatal consequences; damages were assessed in specified sums and the court ordered that the 3rd Defendant contribute 100% as between defendants under Cap.377.
