The appellant failed to establish a reasonable excuse for non-payment; the alleged agreement absolving him of personal liability was not proven and would in any event breach professional duties to client and court; the Law Society's intervention did not excuse non-payment because the solicitor retained a cause of action against the client; accordingly the Tribunal's finding that the complaint was proved was upheld and the appeal dismissed.
