On the evidence the cubicle was effectively in seclusion (blinds, foam on windows, darkness) and the installation of blinds and employment of an unapproved person occurred with the licensee's knowledge or could have been prevented by the exercise of reasonable supervision and diligence; the appellant failed to satisfy the statutory two‑part defence in s.13(2) and the convictions must be upheld.
