On the facts and law the Court held s.8(1)(a) and (b) of the Telecommunication Ordinance cover both services and apparatus and are regulatory strict liability offences; by engaging and using Bestlong the applicant maintained and used unlicensed means and apparatus and was therefore properly convicted; the applicant did not establish a reasonably held honest belief defence.
