The Tribunal erred in treating the unexpired 22-year lease term as valueless because of the possibility of refusal of a dairy licence under s.12(c); the appeal is allowed, the Tribunal's award set aside and the matter remitted to the Lands Tribunal to assess compensation for the unexpired lease term in light of the Court's reasoning; the appellate court will not substitute the Tribunal's alternative provisional figure but remit for reassessment.
