Leave to appeal was refused because no reasonably arguable case of unconstitutionality was shown: the licensing scheme and s23 pursue a legitimate aim and are proportionate; there was no established factual or legal basis that the Communications Authority breached s4(4) or that Ocean Technology was wrongly decided, so unconstitutionality could not operate as a defence to the s23 charge.
