Given the binding Court of Appeal authority in Chan Tin Shi that Cap.150 creates a new estate, the defendant's adverse possession defence could not succeed and the plaintiff was entitled to summary judgment; however, exercising discretion the court dismissed the appeal but ordered a stay of execution of the Master's judgment pending the Court of Final Appeal's decision in Chan Tin Shi to avoid prejudice to the defendant.
