Even if a promissory estoppel arose from the 1980/81 conversation, it could not be extended to relieve the plaintiff of the express contractual requirement in Clause 22 to serve a written claim within the specified period; the plaintiff failed to comply and therefore the appeal is allowed and the earlier judgment for the plaintiffs set aside.
