The Court refused leave because the proposed appeal did not raise questions of great general or public importance; resolution of the central issue (misnomer v substitution) is fact-sensitive; Order 20 rule 5(3) does not render the prior judicial test irrelevant and in any event was not available to the plaintiffs because the Hague-Visby Rules limitation had expired; accordingly leave to appeal to the Court of Final Appeal was denied and costs awarded to the plaintiffs.
