By majority the Court of Appeal upheld an indemnity basis for the successful party's costs but reduced the recoverable proportion to 75% (from the judge's 85%), set aside the direction to include LiveNote charges in recoverable costs, ordered the Wife to pay the Father's costs of the main appeal to be taxed on a party-and-party basis with certificate for four counsel, and ordered that each party bear their own costs of the Costs Appeal (end result reflecting interference with the trial judge's costs discretion where certain factual findings were disturbed).
