Harbour Front lacked locus to seek a stay of the setting aside proceedings by linking those proceedings to the adjudication of proofs of debt because that would improperly mix Harbour Front's role as respondent in the setting aside litigation with its separate capacity as a potential creditor; accordingly the Stay Application was dismissed and adjudication of proofs remains a matter for the Official Receiver to pursue if funded.
