Plaintiff, as a licensed money lender and legal chargee of a half-share, has locus standi under s3 PO and having complied with MLO and RDC requirements, is entitled to an order for sale under s6(1) PO because partition is impracticable, the 1st Defendant defaulted and did not appear, the 2nd Defendant consents and will purchase the half-share subject to terms protecting the first mortgagee, and no opposing co-owner discharged the burden to show sale would be unjust.
