A debtor retains the locus to present a bankruptcy petition under section 3(1)(b) notwithstanding that an IVA remains in force; the words '(other than the debtor)' in section 3(1)(c) are descriptive of that paragraph and do not operate to exclude the debtor from presenting under (b); any abuse or tactical exploitation can be addressed by existing powers to dismiss abusive petitions and other statutory sanctions.
