Because the plaintiffs' pursuit of the loss of accumulation of wealth involved a novel legal issue and was reasonable, the defendants were not entitled to an apportionment of costs or retrospective costs from the dates relied on; payments into court and the Calderbank offer did not justify altering the costs order; accordingly the costs order nisi was made absolute in favour of the plaintiffs with a certificate for counsel.
