Because the magistrate accepted the prosecution evidence that established the quantity/packets threshold under s.46 and there was no evidence capable of rebutting the s.46 presumption, he was not required to state that he applied the presumption; the conviction for possession for the purpose of unlawful trafficking was therefore upheld. If rebuttal evidence exists the magistrate must address it and give reasons for rejecting it.
