The High Court upheld the magistrate's factual finding that the watch was a gift to PW1 and that the appellant pawned it without PW1's consent; applying the Ghosh test the appellant's conduct was dishonest and the elements of theft were proved beyond reasonable doubt, so there was no reversible error in the credibility findings or legal application and the conviction must stand.
