On the rehearing the Court was satisfied PW1 was credible and his evidence established that the appellant twice handled boxes which matched those found in the van; given the location, packaging, number of boxes and lack of any admissible innocent explanation, the only reasonable inference was that the appellant placed the boxes into the vehicle while acting as an odd job worker; those facts proved employment contrary to s38AA beyond reasonable doubt, so the conviction stood.
