The Court set aside the Charging Order Absolute granted on 15 December 2023 and directed that a preliminary issue on the beneficial ownership of the TKO Property be tried before determination of the charging order because there is a genuine dispute requiring trial; ex‑parte non‑disclosure of the dispute did not, in all the circumstances, preclude granting interim preservation relief, but the substantive question must be resolved first; concerns of over‑security do not preclude a charging order where maintenance arrears are continuing.
