The magistrate correctly found that the receipt, once stamped and signed with a counterfeit chop purporting to be from Sun Hung Kai, was a false instrument under s.69(a)(ii) and that the particulars adequately pleaded s.76(1) so the omission to specify the subsection on the charge sheet was not fatal; convictions were therefore upheld and Charge 1 amended to record s.76(1).
