The Court of Appeal held that the constable's arrest and detention were acts of the class he was authorised to perform and were done in the course of his employment despite malice; malice or corrupt motive alone did not exclude vicarious liability of the Crown, so the Attorney General is vicariously liable for the false imprisonment.
