Leave to appeal was refused because the applicant failed to demonstrate any error of law in the Tribunal's judgment and there was no reasonable prospect of success; on proper construction the DMC authorizes the respondent to organize recreational activities, the planters are common parts not private fixtures and the respondent's legal advice does not estop it nor displace the Tribunal's power to construe the DMC; CECO did not apply to the pre-existing DMC.
