The appeal was allowed because, on the balance of convenience, it was unjust to continue an injunction compelling the defendant to set aside funds given its business model and asset illiquidity, the plaintiffs' failure to disclose the Singapore injunction was not sufficiently material to require discharge, and the plaintiffs' remedy was in substance monetary so there was no pressing need to preserve the proceeds; accordingly the continuation order and ancillary disclosure order were set aside.
