Because the parties were validly married by Chinese customary rites in 1960 the registry office ceremony of 1961 did not create a new marriage 'contracted under the Marriage Ordinance'; the Court therefore lacked jurisdiction under the Matrimonial Causes Ordinance to dissolve the 1960 customary marriage and the petition must be dismissed.
