The application was dismissed because the applicant failed to prove essential elements of a customary Chinese marriage and failed to adduce expert or adequate evidence: no proof the ceremony occurred in Hong Kong, no evidence of betrothal or marriage contract, no proof of conveyance or family consent/participation, unclear ancestor worship and uncertain character of the banquet; accordingly the court could not be satisfied that the ceremony complied with s.7(2) and refused the declaration under s.9.
