The application to consolidate was dismissed because the judge found the original separate trial arrangements were a pragmatic use of limited court resources, there were insufficient grounds to change those arrangements given unavailable large court facilities in the proposed period and the realistic risk of prejudice and logistical difficulty for defendants and counsel; hence consolidation would not be appropriate.
