Where a Charging Order is absolute, the registered proprietor is absent and unlikely to discharge the debt, the occupier does not have a superior legal position, and the creditor has no alternative remedy after prolonged default, the court will grant an order for sale notwithstanding the apparent disproportion between the small debt and the property's value and despite concerns about displacement of occupants if the property is not being used as a matrimonial home.
