A thief's intention to "permanently deprive" under s17 requires deprivation of the whole of the victim's existing legal interest; obtaining a leasehold shorter than the victim's remaining interest does not satisfy the permanence requirement and therefore, on the admitted facts, no offence under s17 was disclosed; accordingly the appellate court may quash convictions entered after guilty pleas when the facts admit no offence.
