The Director's decisions to remove refugee claimants are subject to judicial review; when the Director relies on a policy/practice of not returning persons whose fear of persecution is well-founded, the Director must independently determine or anxiously scrutinize whether a claimant's fear is well-founded and such determinations must meet high standards of fairness; appeals are allowed for failure to make such independent determinations.
