The Magistrate's factual findings that the footage and DVD were authentic, untampered with and corroborated the prosecution witnesses were justified by forensic examination and the continuity and consistency of the recording; mens rea for perverting the course of public justice could be properly inferred from the appellant's demonstrably false representations and conduct; the assault and excessive use of force were proved on the footage; and the sentencing exercise fell within the proper discretionary range — therefore the convictions and sentence are upheld and the appeal dismissed.

Magistrate was entitled to accept or reject conflicting expert evidence; admission of a prosecution-employed expert did not create a real possibility of bias; the Nedrick/Woollin virtual certainty evidential test applies to offences of specific intent generally and, applied on the facts, supported a finding that the appellant intended or foresaw as virtually certain the creation of a false appearance; the conviction, four-month custodial sentence and SFC investigation costs order were lawful and not excessive.
